Terms of Service

1. Agreement
By creating an account or using the WorkPulse platform — including the website, dashboard, desktop agent, and APIs ("Service") — you agree to these Terms of Service ("Terms"). If you are using WorkPulse on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
WorkPulse is a cloud-hosted activity monitoring platform for remote teams. The Service includes:
- A desktop agent that tracks activity metrics, captures screenshots, and monitors app/website usage
- A web dashboard for supervisors to view reports and manage teams
- REST and WebSocket APIs for data access
- Cloud storage for screenshots, recordings, and activity data
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to create an account
- One organization account per company; sub-accounts are managed via invitations
4. Acceptable Use
You agree to use WorkPulse only for lawful purposes, in accordance with our Acceptable Use Policy, which is part of these Terms. You must not:
- Install the agent on devices without the device owner's knowledge or consent, except where permitted by applicable law and your organization's policies
- Use the Service to monitor individuals who are not employees or contractors of your organization
- Attempt to reverse-engineer, decompile, or tamper with the desktop agent
- Use the Service to collect data for purposes other than workforce management
- Resell, sublicense, or redistribute the Service without written permission
- Interfere with or disrupt the Service's infrastructure
5. Organization Responsibilities
For personal data about your workforce, you are the data controller and WorkPulse is your data processor; our processing is governed by the Data Processing Agreement. As the subscribing organization, you are responsible for:
- Legal compliance: ensuring that your use of WorkPulse complies with all applicable employment, privacy, and data protection laws in your jurisdiction
- Employee notification: informing employees that monitoring software is installed on their work devices, unless silent mode is legally permitted in your jurisdiction
- Consent: obtaining any required consent from employees before deploying the agent
- Data access: managing which supervisors and administrators have access to employee activity data
6. Pricing and Payment
- WorkPulse is offered on a pay-per-active-seat, per-month subscription basis
- An active seat is a user (check-in mode) or device (silent mode) that tracks 32 or more hours of activity in a billing month
- Seats below the 32-hour threshold are not billed
- Pricing is published on our website and may change with 30 days' notice
- Payments are processed through LemonSqueezy; you agree to their terms of service as well
- Account creation is free — no credit card required until active seats are billed
- Past-due accounts enter a 5-day grace period before access is suspended
7. Cancellation and Refunds
- You may cancel your subscription at any time from the billing portal
- Cancellation takes effect at the end of the current billing period — no proration
- After cancellation, your data is retained for 30 days, then permanently deleted
- Refunds are not provided for partial billing periods
8. Data Retention
- Activity data is retained for 90 days by default
- Organizations may configure extended retention (6 months, 1 year, or unlimited) as a paid add-on
- Expired data is permanently deleted by an automated daily process
- Audit logs and agent security events are never deleted (compliance requirement)
- After subscription cancellation, all data is deleted after 30 days
9. Device Registration
- Devices are registered to your organization using a 6-character code generated by an administrator
- Registration codes expire after 24 hours
- Each device is identified by a unique fingerprint (hash of hardware identifiers)
- Organizations can deactivate devices at any time from the dashboard
- In silent mode, billing is per-device; in check-in mode, billing is per-user across devices
10. Data Ownership
- Your data: you retain ownership of all data collected through the Service (activity metrics, screenshots, recordings, session data)
- Our platform: we retain ownership of the WorkPulse software, infrastructure, algorithms, and documentation
- License to us: you grant us a limited license to process, store, and display your data solely for the purpose of providing the Service
- Aggregated data: we may use anonymized, aggregated data for product improvement and benchmarking; this data cannot be traced to individual users or organizations
11. Service Availability
We strive for high availability but do not guarantee uninterrupted service. The desktop agent includes offline mode — activity is tracked locally and synced when connectivity resumes. We are not liable for data loss caused by extended offline periods beyond the agent's local storage capacity.
12. Security
We implement industry-standard security measures including encryption in transit (TLS 1.2+), encryption at rest (AES-256-GCM), role-based access control, audit logging, and tamper detection. See our Privacy Policy for details.
13. Limitation of Liability
To the maximum extent permitted by law, WorkPulse's total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.
14. Indemnification
You agree to indemnify and hold WorkPulse harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights (including employee privacy rights).
15. Termination
We may suspend or terminate your account if you violate these Terms, fail to pay, or use the Service in a way that threatens the security or integrity of the platform. We will provide reasonable notice when possible. Upon termination, your access is revoked and data is deleted after 30 days.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email to account owners at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
17. Governing Law and Disputes
We aim to resolve any dispute informally first — please contact us at legal@getworkpulse.io before taking other steps. The governing law and venue for these Terms will be specified here once finalized. Nothing in these Terms limits any mandatory rights or protections you have under the laws of your own country or state of residence.
